These Terms of Service ("Terms") govern your use of our website at https://celiscan.app (the "Site"), the Celiscan mobile application (the "Mobile App"), and all related services, features, content, communications, and functionalities provided by Roop Labs, LLC ("Celiscan," "we," "us" or "our") (collectively, the "Services"). PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.
By accessing or using our Services in any manner, or by clicking "I Accept" (if applicable), you agree to be bound by these Terms. If you do not agree to these Terms or any modifications made by us in the future, please do not use the Services.
Platform Services
Celiscan is a product scanner focused on gluten information for people with celiac disease and gluten sensitivity. Our Services let you scan a product's barcode and receive a verdict, Gluten-Free, May Contain, Contains Gluten, or Not Sure Yet, along with the ingredient evidence behind it. The Services also let you save products to a personal Pantry for later reference.
Acknowledgement and Disclaimers
a. Celiscan is informational and is not medical advice. It does not diagnose, treat, or provide guidance for any medical condition. Always consult a qualified healthcare provider about your dietary needs.
b. Although we work to keep product and ingredient data accurate and current, Celiscan does not guarantee the accuracy, completeness, or timeliness of any verdict or information provided through the Services. Ingredient formulations, labeling, and manufacturing practices can change without notice.
c. Celiscan is deliberately conservative: when the evidence available to us is insufficient, we label a product "Not Sure Yet" rather than claim it is safe. A "Gluten-Free" verdict is not a guarantee of safety, and you should always check the physical packaging yourself before consuming any product, especially if you have celiac disease or a severe gluten sensitivity.
d. Your use of the Services is at your sole risk. Celiscan, its affiliates, officers, directors, employees, or agents are not responsible for any harm, loss, or inconvenience arising from reliance on any verdict or information provided.
General Use and Consent
Subject to these Terms, you are responsible for your use of the Services. Your use of the Services is governed by these Terms and all applicable laws. If you do not agree with these Terms, do not use our Services.
Privacy
Your privacy is important to us. Celiscan has no accounts and no sign-up; your Pantry and scan history stay on your device. Your access to and use of our Services is subject to our Privacy Policy, which is incorporated herein by reference.
Eligibility
By using the Services, you represent and warrant that you are at least 18 years old (or the applicable age of majority in your jurisdiction) and are legally capable of entering into binding agreements, or that you are using the Services under the supervision of a parent or guardian.
Feedback
If you report an incorrect verdict or send us other feedback, we may use it to improve the Services without compensation or attribution to you.
Compliance With Laws
You shall use the Services only for lawful purposes and in compliance with all applicable federal, state, local, and international laws and regulations.
Fees and Payment
a. Celiscan offers a free trial, after which continued access requires a Celiscan Pro subscription.
b. Celiscan Pro is available as an auto-renewing subscription at $39.99 per year or $9.99 per month, each with a 7-day free trial. You will not be charged if you cancel during the trial period. All fees and charges are non-refundable except as provided by law or by Apple's refund policies.
c. We reserve the right to change pricing at any time; changes will not affect an already-active billing period.
Subscriptions
a. Celiscan Pro is billed and processed entirely through the Apple App Store. Your subscription automatically renews until you cancel it.
b. To cancel, go to Settings → your name → Subscriptions on your iPhone and cancel Celiscan Pro. Cancellation takes effect at the end of the current billing period.
c. Refunds are handled by Apple in accordance with the App Store's terms; we do not process payments or refunds directly.
License to the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial use.
Restrictions on Use
You agree not to:
- Reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the Services without our express written consent.
- Reverse engineer, decompile, disassemble, or create derivative works of any part of the Services.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Use the Services in any manner that could damage, disable, overburden, or impair the Services.
- Use any automated means (such as robots or data mining) to access or collect data from the Services without our prior written permission.
Third-Party Data Sources
Product and ingredient data displayed in the Services comes primarily from Open Food Facts (an open, community-maintained database licensed under the Open Database License) and USDA FoodData Central, supplemented by our own review. We are not responsible for errors originating in third-party data sources.
Suspension and Termination
We reserve the right to suspend, restrict, or terminate your access to the Services at any time, for any reason, including a breach of these Terms. Certain provisions of these Terms, such as disclaimers, indemnifications, and limitations of liability, will survive termination.
Assumption of Risks; Release
a. You acknowledge that you are solely responsible for confirming the gluten status of any product before consuming it, regardless of the verdict shown in the Services.
b. You assume all risks associated with your use of the Services, including inaccuracies in product or ingredient data, and agree that Celiscan is not liable for any damages or losses arising from such use.
c. By using our Services, you release and hold harmless Celiscan and its affiliates, directors, officers, employees, and agents from any and all claims, liabilities, damages, and expenses arising out of or in connection with your use of the Services.
Indemnification
You agree to indemnify, defend, and hold harmless Celiscan, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services or your violation of these Terms.
Limitations of Liability and Disclaimers
a. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
b. NEITHER CELISCAN NOR ANY OF ITS AFFILIATES SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
c. OUR AGGREGATE LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
Governing Law
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law principles.
Amendments
We reserve the right to modify these Terms at any time by posting the revised Terms on our Site. Your continued use of the Services following any such changes constitutes your acceptance of the new Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
